ACADEMY 48 WAIVER AND RELEASE OF LIABILITY

Assumption of Risk / Waiver of Liability / Indemnification Agreement

In consideration of being allowed to participate in Academy 48 athletic programs, leagues, tournaments, training sessions, and related events and activities (collectively referred to as the “Programs”), the undersigned acknowledges, appreciates, and agrees that:

Participation in the Programs includes possible exposure to and illness from infectious diseases including, but not limited to, MRSA, influenza, and COVID-19. While safety measures and personal discipline may reduce this risk, the risk of serious illness or death does exist.
I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation.
I agree to comply with all stated and customary terms and conditions for participation regarding protection against infectious diseases. If I observe any unusual or significant hazard during my participation, I will immediately remove myself and bring it to the attention of Academy 48 staff or officials.
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Academy 48, its officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, the owners and lessors of premises used to conduct the event (“Releasees”), with respect to any and all illness, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

By registering, I acknowledge that I have read and understand this release of liability and assumption of risk agreement, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without inducement.

For Participants of Minority Age (Under 18 at the Time of Registration)

This is to certify that I, as parent/guardian with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward, including the risks of participation and their personal responsibility for adhering to the rules for protection against communicable diseases.

Furthermore, my child/ward understands and accepts these risks and responsibilities. I, for myself, my spouse, and my child/ward, consent and agree to this release provided above and further agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities, even if arising from negligence, to the fullest extent permitted by law.

Release of Liability, Waiver of Claims, and Indemnity Agreement

In consideration for being permitted to participate in Academy 48 Programs, I agree as follows:

I hereby release and hold harmless Academy 48, its directors, officers, employees, representatives, agents, volunteers, and facility partners (“Releasees”) from any and all claims for injury, disability, death, or property damage arising from participation in Academy 48 Programs, whether caused by negligence or otherwise.
I agree to indemnify and hold harmless the Releasees for any and all liabilities, damages, costs, or expenses incurred as a result of my or my child’s participation in Academy 48 Programs.
I understand that this agreement applies to all current and future participation and remains in effect unless revoked in writing.

Consent for Emergency Medical Treatment

In the event of a medical emergency, I authorize Academy 48 and its representatives to secure emergency medical treatment for the participant(s). I grant permission to employ any licensed physician or healthcare facility to provide necessary care. I agree that neither Academy 48 nor its representatives shall be liable for any decisions made in good faith under this authorization.

Photography / Videography Release

I grant permission to Academy 48 to use any photograph, video, or likeness of myself or my child taken during Academy 48 events or activities for promotional or educational purposes, including social media, websites, publications, and advertising, without compensation.

Weather Policy

I understand that Academy 48 cannot control the weather. Games, practices, or events canceled due to weather may not be rescheduled, and no compensation will be issued in such circumstances.

No Refund Policy

All registrations are final. Refunds will not be issued except in cases where Academy 48 cancels a program entirely.

Express Assumption of Risk

I acknowledge that sports and athletic activities involve inherent risks, including but not limited to:

Injuries from contact with other participants or equipment.
Equipment failure or misuse.
Surface or environmental hazards, including field conditions or weather.
Travel to and from activity sites.
The risk of serious injury, disability, or death.

I understand these risks are not exhaustive and that unknown or unanticipated risks may arise. I voluntarily assume all risks associated with participation.

General Policies

Participants must follow all Academy 48 rules and the instructions of coaches and officials.
Protective gear required by the sport’s governing body must be worn at all times.
Academy 48 reserves the right to suspend or remove any participant for unsafe or inappropriate behavior.
